Although
we paid the general contractor, Michael Palmentiero, $7,900 for "change orders," he
demanded and received far larger sums on behalf of MyHome LLC for work that was not yet completed.
Each time Palmentiero implied work would not resume
until such payments were made. Fearing more rain damage from
further delays, we wrote a check on Sept. 3 for
$41,250 supposedly due upon "Completion of rough-ins
(doors, windows, electric and plumbing),” even though windows
were not installed until two weeks later and doors, electric and
plumbing were not installed until late October.
Three weeks later,
Michael Palmentiero demanded and received a $46,250
payment supposedly due when the "House is weather tight," yet no
siding, sheathing or French doors were installed.
MyHome accepted and deposited these checks without
question. Our law
suit includes an action against them for fraud and
misrepresentation.
