Lior and Michael 

In preparation for our meeting tomorrow at 9:30 AM, I'm attaching a detailed list of remaining work to be done at 42 Maple. The purpose of the list is to identify what needs to be completed to reach the "Substantial Completion" point as described in our contract with MyHome on page 5. The fifth payment, due "Upon substantial completion" (as opposed to "before" substantial completion), will bring our total MyHome payments to 95%. To date, we have paid 85% of the total investment which was supposedly due once the house was "weather tight."

The second purpose of tomorrow's meeting is to agree on the dollar amount of the fifth payment, taking into account expenditures Meggan and I have made for materials originally included in MyHome's budget. Lior, I will forward to you early this evening an updated spreadsheet listing these proposed credits. At tomorrow's meeting we should also attempt to resolve the dollar value of disputed items.

With these issues resolved I am hopeful we can resume construction in earnest.

Good afternoon, Lior and Michael,

Thank you both for your efforts yesterday to reach compromises on "extras" and nail down what tasks remain to reach "substantial completion" as well as final completion. Now if we can just get workers on the job site!

I'm attaching an updated budget and punch list reflecting our agreements. I'm also verifying that check number 3717 in the amount of $3,775 payable to "Michael Palmentiero" was for the following expenses:

Bathroom vent pipe relocation $300 
Emergency plumber visit $175 
Install plywood under eves $700 
Outriggers installed $300 
2nd floor 8-3/4" fascia redo $300 
Sheetrock to cathedral ceiling $1,000 
Exposed and extended eves, plywood $1,000 

As discussed at the meeting, I expect both the punch list and budget to be "working documents" and subject to frequent updating. Please review same and let me know if you spot any problems.

Project summary:
1 1/2 story to two story conversion.

Broke ground July 16th.

Total MyHome payments: $154,000 for a $185,000 job (85%)

No work on exterior on house in more than seven weeks, except for two days for exterior trim. 

Water damage to first floor starting Aug. 15th

10 crates of stone veneer sitting in my front yard since Aug. 27.

Left voice mail @ 2:30 pm 11/18/08 for Mr. Mayan Metzler

Mr. Metzler called back about 3:45 pm, then conference called in Lior. Lior said he thought he could apply pressure on Michael P. to finish the job, which should not take more than two weeks. Such pressure is based on Lior withholding one or more future jobs. Lior said he would call me tomorrow morning about discussing a specific time table. I proposed we include penalties (e.g., $200 per day) if workers don't show up, or the final deadline is missed. Lior seemed agreeable to the idea.

Subject: 42 Maple Ave. - Schedule and deadlines

Lior, 

Attached is an updated punch list reflecting the timetable we agreed to last Thursday, Nov. 20. Specifically, it itemizes work Michael needs to complete by Dec. 1 so interior painting can begin (scheduled for Dec. 1 - 6), and exterior work Thelmo and/or Michael need to complete by Dec. 8 so exterior painting can begin (Dec. 8 - 13). 

As we discussed, could you please verify that MyHome will compensate Meggan and I for delays in the above work (including interior and exterior painting) at a rate of $200 per working day (including Saturdays but excluding holidays) beginning Thursday, Dec. 18, one week before Christmas? This of course excludes repairs and repainting of the damaged first floor, which we agreed would take place in January.

Unfortunately, work has lagged for the month of November: 5 days with workmen on site vs. 17 days (excluding Sundays) of no work done. Meggan and I are hopeful the $200 incentive described above will move our project towards completion, as promised during our telephone conference with Mayan Metzler on Nov. 18.
