Subject: 42 Maple Ave. - Schedule and deadlines
Good afternoon, Mr. Metzler,
Further to our telephone conference with Lior Noy on Nov. 18,
could you please nudge Lior to address the items in my Nov. 26
email, below? As the deadlines we agreed to are fast
approaching, I'd like some written confirmation of the penalty
terms we discussed.
I greatly appreciate your assistance in facilitating this
matter.
Sincerely,
Michael Mackay

Subject: 42 Maple Ave. - Contract and Construction Details
Dear Bob,
Thanks so much for spending the extra time with me this
evening reviewing the myriad structural problems with our
renovation. Attached is our contract with MyHome dated April 4,
2008. Includes MyHome's consumer protection home improvement no.
(WC-18311-H06) and contact information (Lior Noy, Branch
Manager) http://www.myhomeus.com/
Other principal players:
Trevor Spearman (Architect hired by MyHome), AIA, NCARB
Michael Palmentiero (General Contractor hired by MyHome),
d/b/a Touch Of Class Home Improvements, Inc. (http://www.westchestergov.com/consumergas/LicenseResultSearchAll.asp?page=T)
Lenny Russo, Building Inspector, Village of Pelham - was very
involved in zoning and permit approval process (six months)
Village of Pelham Architectural Review Board - very concerned
about preserving historical integrity of our house. Actually
came up with the overall design of the house as seen from the
street.
I'll be forwarding other documents after I've gone through my
files.
Thanks again for your time and expertise.

Subject: 42 Maple - Engineer's inspection
Good morning, Lior,
A licensed engineer affiliated with HouseMasters came to our
house last Saturday and examined both the interior and exterior
for signs of water damage. He also looked for signs of stress
fractures. He made several informal recommendations (e.g., to
remove the damaged stucco to the line at the top of the window
framing and then reevaluate the areas below), but believed an
analysis for mold exposure was necessary, considering the
exterior walls have remained uncovered for more than four
months. Does MyHome have an environmental inspection service
they use to perform mold analyses? I will forward his report
when it is ready.
On the painting front, your crew is moving along nicely and
have addressed several items on the punch list that had been
assigned to Touch-of-Class.
On the stucco front, I just want to reiterate our need to
have the work performed properly at the correct temperatures
with proper materials. I was surprised to see the subcontractor
using tar paper instead of Tyvek to cover the exposed plywood.
Isn't Tyvek the preferred standard?
Looking forward to hearing from you soon.

Good morning, Trevor,
I hope this holiday seasons finds you modestly overwhelmed,
both professionally and with family.
Could you please FedEx me two fresh sets of final drawings
for 42 Maple? My existing set is woefully dog-eared and starting
to fade. Be sure to invoice me for the costs.
Thanks again and have a happy new year.

Bob, while expanding the timeline I noticed an error in when
the windows were installed. It was 9/18/08, NOT 9/3/08, as
stated on my original time line. Don't know if this alters your
report any.
Thanks again,
Michael

Thank you, Brian, and please accept my apologies for confusing
your name with Bob's. My hearing has been one of the many
casualties of all this noisy construction :-)
I will scrutinize your report and follow up with you re:
possible next steps. Are there any attorneys you have worked
with who specialize in claims relating to damages such as ours?
Thanks again,
Michael

Subject: RE: 42 Maple - Engineer's inspection follow-up
Good afternoon, Lior,
I have received HouseMasters' draft engineering report and
will forward a final copy as soon as a few minor clarifications
are made. In the mean time, Larry Danner, the P.E. who prepared
the report, recommends remediation of existing or possible
mold/mildew problems according to the NYC Dept. of Health and
Mental Hygiene's "Guidelines on Assessment and Remediation
of Fungi in Indoor Environments." I'm attaching a copy of
the "Guidelines" (which I have not yet read) for your
review so you can begin planning accordingly.
Meggan and I feel strongly Michael Palmentiero (Touch Of
Class) should NOT be the contractor to perform this work, given
what the professional engineer describes as his "complete
lack of compliance with standard building practice"
exhibited on this project.
I greatly appreciate your addressing these concerns.
